Paid Time Off and the Family Medical Leave Act

Employers recognize that in order to keep their employees happy, and therefore productive, they cannot expect them to work tirelessly without a break. That is why the vast majority of employers give their employees time off to take care of personal business, stay home from work when sick, or enjoy periods of rest and relaxation.

Traditional leave programs segregate time off into categories like vacation, sick time, and personal time that requires HR professionals to track both the time off and the reason it is being taken. Many employers have decided to get away from policing the circumstances of an employee’s absence by just creating a bank of paid leave (PTO) that can be used for any reason.

Administration of Family and Medical Leave Act (FMLA) leave becomes more challenging in a PTO program since the employer is not necessarily aware of the reason for the absence. A serious health condition under the FMLA triggers an obligation to notify an employee of his or her FMLA rights and starts the counting of the time against the 12 weeks of leave. The seminar will focus on PTO programs and its interaction with the FMLA.
